A claim is a written request to stop the right’s infringement and legitimate interests of right holder or the counterparty which directed against the offender. For a number of civil cases complaint procedure is compulsory.

Complaint procedure is one of the most effective ways to protect intellectual property rights when they are infringed as well as non-compliance with counterparty obligations under the contract.

The claim contains an indication of intellectual property rights which are infringed, of requirements to eliminate it and to compensate damages. In addition, the claim shall contain the norms of current legislation, justifying the declared requirements, as well as indicate the sanctions provided by the law for the continuation of an offense that has a sobering effect on unfair competitor.

Based on our long practice we can say that about half of our disputes relating to infringements of intellectual property rights in the protected results of intellectual activity and means of individualization often resolved at the pre-trial preparation which is optimal for all parties.
